Comedian Tracy Morgan is finally out of the rehabilitation center following the serious and tragic crash in New Jersey that left him seriously injured and hospitalized and killed another man.
The man killed was 62-year-old comedian James McNair, aka Jimmy Mack.
Morgan is now suing Wal-Mart for one of their tractor-trailer driver’s involvement in the accident.
Comedian Ardley Fuqua and Jeffrey and Krista Millea are also named in the suit.
The comedians lawsuit claims that the driver of one of Wal-Mart’s tractor-trailers, 35 year old Kevin Roper, was negligent when Roper rammed into Morgan’s limousine van.
The lawsuit alleges that the truck driver was asleep at the wheel after being awake over 24 hours driving over 700 miles from his home in Jonesboro, Georgia to work in Delaware.
The lawsuit claims the commute was “unreasonable.”
Morgan and others are seeking unspecified punitive damages from Wal-Mart who has, since the accident, apologized for ‘one of their trucks being involved’ and stated that they are cooperating in the investigation of the accident and want to ‘do the right thing for all involved’.
